Adopt an urgency ordinance amending Chapter 8B of the Gilroy City Code relating to the voluntary campaign expenditure ceiling and making the finding that immediate implementation of the amendments is necessary to provide certainty to candidates and committees participating in the upcoming 2026 election cycle and to promote orderly election administration.

Deny Rock Zone's Appeal and suspend their Tobacco Retailer's Permit for one year.

Approve the reopening of the Wayland and Hanna parking lots on a trial basis on Fridays, Saturdays and Sundays from 7:00 A.M. to 9:00 P.M. with re-evaluation from staff back to Council in three months.

Adopt a resolution of the City Council of the City of Gilroy submitting to the qualified electors of the City of Gilroy, at the November 3, 2026, general municipal election previously called by Resolution No. 2026-29, a ballot measure to add Article V, sections 22.33 through and including 22.48 to Chapter 22 of the Gilroy City Code imposing a 0.25% (one-quarter of one percent) public safety special transactions and use tax with citizen oversight.

Direct staff to bring back the Flag Flying Policy to remove the required fees and signatures and change the language on the policy to include a third flag pole.

Authorize the City to enter into Agreements in an amount not to exceed $750,000 each with San Jose Conservation Corps, Landscape Maintenance America dba California Highway Adoption Company, and FS Global for a Three-Year On-Call Encampment Cleanup Program Services with two one-year extension options and to authorize the City Administrator to execute the agreements and adopt a resolution amending the FY 2026-2027 adopted budgets.

Allow Camp Hope to continue to operate how it is currently functioning on a month-to-month basis, barring any issues that arise with our Police Department and Quality of Life Officers and can be revised at any time the Council chooses.

Approve the Community Development Block Grant (CDBG) Citizen Participation Plan and Program Year 2026-2027 Annual Action Plan including funding allocations, direct the Community Development Director to submit the plans to the U.S. Department of Housing and Urban Development, and adopt a resolution amending the Fiscal Year 2026-2027 budget within the Community Development Block Grant Fund.

Determine this project is exempt from further environmental review pursuant to State CEQA Guidelines Section 15332 (Class 32).

Adopt a resolution approving Vesting Tentative Map TM 24-01, subject to the findings and conditions outlined in the draft resolution.

Adopt a resolution approving Architectural and Site Review Permit AS 24-07, subject to the findings and conditions provided in the draft resolution.

Adopt Resolution A calling a General Municipal Election for Municipal Officers, requesting the Santa Clara County Board of Supervisors authorize consolidation with the Statewide General Election to be held on November 3, 2026.

Concur with setting the initial Transient Occupancy Tax rate at eleven percent (11%).

Adopt Resolution B placing a measure on the ballot increasing the rate of the City's Transient Occupancy (Hotel) Tax from nine percent (9%) to a not-to-exceed maximum rate of thirteen percent (13%).

Award a contract to Hello Housing to administer the Below Market Rate (BMR) Housing Program from July 1, 2026, to June 30, 2028, with three, one-year extension options, and authorize the City Administrator to execute the contract and associated documents and adopt the resolution amending the Fiscal Year 2026-27 budget to increase appropriations in the Housing Trust Fund by $6,240 and the Los Arroyos Fund by $5,760 for the Fiscal Year 2027 services of this contract.

Award a Public Works contract in the amount of $198,900 to 17 Mile Construction for the tenant improvement project at 641 Old Gilroy St. and approve a project contingency of $19,100 for a total project authorization of $218,000 as well as authorize the City Administrator to execute the contract documents and approve any April 20, 2026 | 6:00 PM Page 5 of 10 City Council Minutes future change orders within the project contingency.

Adopt a Resolution of the City Council of the City of Gilroy authorizing the Fire Chief to abate the nuisance arising out of weeds growing and refuse accumulating upon property in the City of Gilroy, pursuant to Section 12.51 of the Gilroy City Code.

Introduce and waive the first reading of the Ordinance amending Chapter 15, Section 15.11 of the Gilroy City Code adding reference to California Vehicle Code Section 22358 et seq. allowing the City Council to reduce prima facie speed limits in school zones from 25 mph to 15 mph or 20 mph per Assembly Bill 382.

Direct staff to place the Ordinance for adoption at the May 18, 2026 meeting and adopt a resolution approving a budget amendment adding $150,000 from Fund 220 (Vehicle Registration Fee) to Capital Project Number 801120 (Citywide Safety Improvements).

Approve a two-year agreement with Santa Clara County Communications April 20, 2026 | 6:00 PM Page 7 of 10 City Council Minutes Department for Emergency Medical Dispatch services, in the amount of $170,256 in FY 27 and $329,803 in FY 28, and authorize the City Administrator to execute the contract and associated documents.

Approve the establishment of a City Council Homelessness Ad Hoc Subcommittee and appoint Council Member Bracco, Council Member Ramirez and Mayor Bozzo to serve on the Subcommittee and proceed with the Homebase proposal and option of facilitation of six (6) meetings with four (4) virtual and two (2) in-person meetings that will occur at times to be determined later by the three Council Members in consideration with staff.

Council consideration of a future agenda item directing staff to amend Zoning Code Section 30.14.31 (Specific provisions – Noise).

Award a contract to Pros Consulting setting the dollar figure to $225,000 and allowing City staff and the consultant to negotiate a maximum possible scope of work within the budget.

Adopt the attached budget amendment resolution revised to coordinate with the amount of the project.

Award agreements in an amount not-to-exceed $2,000,000 each with 4LEAF, CSG Consultants, TRB+ Associates and True North Compliance Services to provide standard and expedited on-call Building and Fire plan review and inspection services for July 1, 2026 to June 30, 2029, with two one-year extension options.

Authorize the Mayor to sign a Letter of Opposition to the High-Speed Rail Authority's Tax Increment financing proposal.

Receive draft Community Development Block Grant (CDBG) Program Year 2026-2027 Annual Action Plan and draft Citizen Participation Plan and direct staff to allow funding for the public service applicants to be equally distributed.

Adopt a resolution amending the Fiscal Year 2026 Capital Budget by appropriating $157,707 from Fund 422 to Capital Project No. 800460.

Award a contract in the amount of $143,370 to Storm Water Inspection & Maintenance Services Inc. / An Apex Company for FY26 Small Trash Capture Devices Project No. 800460, approve a contingency of $14,337, and Authorize the City Administrator to execute the contract and associated documents.

Adopt a resolution establishing a Community Event Support Program Policy formalizing a non-profit subsidy program for community special events and authorize staff to implement the FY 2026-27 cycle using the updated timeline, review considerations, and reporting requirements.

Receive Budget Report for the Second Quarter of Fiscal Year 2025-26 (FY26), adopt a resolution approving the updated Position Control List for Fiscal Years 2025-2026 and 2026-2027 and adopt a budget amendment resolution.

Accept the report and direct staff to submit the 2025 Annual Progress Report to the California Department of Housing and Community Development and the Governor’s Office of Land Use and Climate Innovation, no later than April 1, 2026.

Council consideration of a future agenda item directing staff to return to Council with options regarding the addition of public hearings to the Architectural and Site Review Permit process.

Adopt a resolution approving the amended and restated Municipal Pooling Authority Joint Exercise of Powers Agreement for Providing Property, Public Liability, and other insurance coverages.

Receive a report on updates regarding Senate Bill 707 (SB 707) amending the Ralph M. Brown Act and adopt a City Council Policy on Disruptions of Telephonic or Internet Service During Public Meetings in compliance with Senate Bill 707.

Award on-call services contracts to Lehr Upfitters and NorCal Emergency Vehicle Installations each in the not to exceed amount of $370,000.

Approve the establishment of a Drone as First Responder (DFR) Pilot Program for the Gilroy Police Department and authorize the City Administrator to execute the BRINC/Motorola Solutions Takeoff Program agreement for a six-year program term.

Determine this action is exempt from environmental review under CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines.

Direct the City Clerk to read the ordinance extending the Urgency Interim Ordinance by title only and to waive further reading.

Adopt an ordinance extending the Urgency Interim Ordinance to prohibit the issuance of any new Tobacco Retailer Permit Citywide for an additional six (6) months and fifteen (15) days.

Adopt a resolution suspending enforcement of Gilroy City Code Chapter 5 for a period not to exceed ninety (90) days, authorizing the City to continue to provide sanitation-related services to the temporary encampment, and abating the encampment after the suspension period.

Adopt a budget amendment resolution in the amount of $1,058,224.31 to purchase a Type I Fire Engine.

Award the purchase of a Rosenbauer Type I Fire Engine in the amount of $1,058,224.31 utilizing Sourcewell Contract No. 113021-RSD and authorize the Interim City Administrator to execute the purchase contract documents,.

Adopt a resolution extending the Mobile Vending Pilot Program through October 31, 2026, to provide additional time for program evaluation, stakeholder feedback, and the drafting of an updated ordinance, in addition the resolution shall incorporate amendments establishing a revocation and suspension process, authorizing the City to revoke or suspend the ability to operate within the City for any vendor who repeatedly violates City ordinances or the requirements of the Mobile Vending Pilot Program.

Review draft policy and adopt a resolution establishing a new Capital Infrastructure Reserve Fund and funding policy.

Adopt a resolution appropriating $310,000 from the newly established Capital Infrastructure Reserve Fund to Project 900780 to the FY26 Capital Budget,

Appoint Matt Morley as City Administrator effective February 9, 2026, and approve City Administrator's Employment Agreement for Matt Morley and authorize the mayor to execute the agreement.

Appoint Harjot Sangha as Interim City Administrator for the period of January 5, 2026 - February 8, 2026.

Determine this action is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines.

Adopt an Urgency Interim Ordinance establishing a temporary prohibition on the issuance or approval of any new Tobacco Retailer Permits citywide within the City of Gilroy pursuant to California Government Code 65858 and make findings, as incorporated in the ordinance, that adoption of the ordinance is necessary for the immediate preservation of public health, safety, and welfare, particularly regarding the protection of minors throughout the City.

Determine the action is exempt from CEQA pursuant to Section 15262 and adopt an extension of the Urgency Interim Ordinance to prohibit the issuance of any new Tobacco Retailer Permit for an additional ten months and fifteen days within the Gilroy Downtown Specific Plan Area.

Approve the Commemorative Flag Flying Application for the Progressive Pride Flag.

Prepare and advertise a Request for Proposal (RFP) for the fabrication and installation of 73 connector pipe screens to meet the City's December 2026 30-percent MS4 trash capture mandate and return to City Council with a budget amendment.

Appoint Council Member Zach Hilton to the position of Mayor Pro Tempore for 2026.

Consent the City Administrator's recommendation to appoint Scot Smithee (CalPERS Retired Annuitant) as Interim Police Chief and adopt a resolution approving the appointment and employment agreement.

Consent the City Administrator's recommendation to appoint Karl Bjarke (CalPERS Retired Annuitant) as Interim Utilities Director effective December 23, 2025 and adopt a resolution approving the appointment.

Consent the City Administrator's recommendation to appoint LeeAnn McPhillips (CalPERS Retired Annuitant) as Interim Administrative Services & Human Resources Director/Risk Manager effective December 31, 2025 and waive the 180-day wait period.

Award opioid remediation grant, reimbursement-based and not to exceed $237,352 to Carry the Vision, for opioid remediation services.

Adopt a resolution amending the 2026 Fiscal Year Budget in the Opioid Settlement Fund by $237,352 and authorize the City Administrator to negotiate and execute the final grant agreement.

Award the interim aquatics center operator contract to The Swimming Swan, LLC for an amount not to exceed $266,662 and authorize the City Administrator to complete negotiations and execute the agreement.

Adopt a resolution to amend the Fiscal Year 2025-26 budget within the Gilroy Library Fund (405) to appropriate $390,660.

Amend a contract with Dewberry Engineers, Inc. to add $29,880 to the contract total for a total amount not to exceed $219,532.26.
